  • Connecticut

    Board Composition

    • The board consists of five (5) members appointed by the governor.

    Rules and Regulations

    • The board requires Architect Registration Examination (ARE) candidates to finish their Intern Development Program (IDP) process prior to sitting for the exam.
    • The state registers individuals for the use of the title registered interior designer. All Connecticut licensed architects automatically qualify for this title and may obtain the Certificate of Registration.
    • The proposed regulations were sent to the Department of Consumer Protection and requires that electronic seals have certain protections to prevent the alteration of the document after it has been sealed.
    • The Department of Consumer Protection and the board drafted proposed regulation changes to examination eligibility that would allow ARE candidates to sit for the exam before completing NCARB’s IDP.
    • Proposed change would make Connecticut consistent with NCARB’s amended policy relative to concurrent completion of the IDP and the ARE.
    • Board approved the draft as presented to them at their May 2, 2014 meeting and instructed the department to advance it to the next step of the approval process.
    • On May 2, 2014, the Connecticut Architectural Licensing Board approved the use of electronic seals.
  • Maine

    Board Composition

    • The board consists of nine (9) members appointed by the governor:
    • Five (5) architects, one of whom may be a professor of architecture
    • One vacancy
    • One (1) landscape architect
    • One (1) certified interior designer
    • Two (2) must be public members
    • Two vacancies

    Current Number of Licensed Architects

    • 1,496 licensed architects
    • 56 ARE candidates in the pipeline
    • In 2013, Maine ARE candidates had a 62 percent overall pass rate on the test.

    Legislation

    • No Legislation effecting the board is currently in process.
    • Rules and Regulations
    • Proposing a rule change to allow reduced hours for IDP effective in June 2015.
    • The Maine rules state: “The applicant completed the NCARB Intern Development Program of at least three years duration. Completion of the Internship is deemed equivalent to three years of qualifying experience.”

    Continuing Education Requirements

    • Does not require continuing education for any professional discipline.
    • Maine AIA has attempted to require continuing education, but the state does not believe it is necessary.

    Online Renewals

    • No longer issues paper renewal notices.
    • All notices are delivered via email and can be completed electronically or through the mail.

    Disciplinary Action

    • No current disciplinary actions before the board.
    • Continues to enforce the requirement that licensees inform the board of any disciplinary action in another jurisdiction or any civil conviction or violation within 10 days of the occurrence. At renewal time, if the board finds these have not been reported, the cases are sent a Letter of Guidance that remains in the licensee’s file for a period of years.

    Board Meetings

    • Board meetings are held every other month. If there are no matters that require a board vote or other disciplinary matters, the meeting is cancelled.
    • The board voted to permit the board clerk to issue licenses and approve sitting for examinations if all of the paperwork conforms with requirements. In the case of an individual who has an unusual path to licensure, the board must vote at the next meeting.
  • Massachusetts

    Board Composition

    • The board consists of five (5) Members appointed by the governor
    • Four (4) architects engaged in the practice of architecture for a period of ten years or more

    Current Issues

    • The board has approved a draft of changes to the regulations, however it is on hold per Governor Baker until April.

  • New Hampshire

    Board Composition

    • The board consists of five (5) members appointed by the governor and council

    • Out-of-state: 1,530

    Continuing Education Requirements

    • Beginning in April 2012, licensees were required to attest that they have complied with the board's continuing education requirements located in Arch 403 of the administrative rules.
    • 12 hours per year
    • 8 HSW and 4 SD
    • Proof of compliance is required to be kept for four years.
    • The board conducted and completed its second continuing education audit, which represented 5 percent of the licensees finding all in compliance in 2014. The third audit will be conducted in May 2015.

    Rules and Regulations

    The New Hampshire Board feels that reducing the IDP contact hours would reduce the integrity of New Hampshire Architects as it would take away “real world” experience learned only on the job. The New Hampshire Board will begin rulemaking in 2015 as the rules are set to expire in 2016; at this time the board plans to address any issues with NCARB’s new policies and procedures.

  • Rhode Island

    Board Composition

    • The board consists of five (5) architect members
    • The “Division of Design Professionals” is housed within the Department of Business Regulation (DBR) and includes four Boards (Architects, Engineers, Land Surveyors and Landscape Architects).

    Current Number of Registered Architects

    • Total number of licensed architects: 1,515
    • In-state: 286
    • Out-of-state: 1,229

    Legislation

    • In the 2015 Legislative Session is underway. The Department of Business Regulation’s (DBR) Legislative Package included removal of a “duplicate license fee” since it’s no longer required.
    • All licenses are now being sent via email only.

    Rules and Regulations

    • The Rules and Regulations are completed and effective as of September 2, 2014.

    Current Activities

    • The board recognized three (3) newly registered architect at an AIA/RI award celebration.

    Continuing Education (CE) Requirements

    • Adopted the NCARB CE Model Language, which is 12 health, safety, and welfare (HSW) continuing education hours (CEHs) annually effective September 2, 2014.
    • Approximately 30 days after the renewal due date, the board conducts a random continuing education audit of approximately 3 percent of the registrants who renewed.

  • Vermont

    Board Composition

    ARE Timing

    Candidates can begin sitting for the exam one year before IDP is completed.

    • Candidates without accredited degrees may sit up to one year before the completion of their training.

    Rules and Regulations

    • 2015 will be a renewal year for architects in Vermont.
    • Offers online renewals, with the mailing date of renewal notices, user IDs and passwords completed in December preceding the renewal date.
    • Currently runs at a surplus, which prompted a review of fee structure although no changes were made after for upcoming renewal cycle.

    Continuing Education

    • Audits for continuing education are issued to approximately 10 percent of licensees, and are reviewed by a board member.

    New Legislation Proposed

    • Possibly making changes to its state rules to streamline and remove ambiguous and/or redundant terminology that may already be described in the Statutes of State Law.
    • Will continue to work on establishing a non-subjective method of evaluating internships beyond the three-year IDP period.

    OPR Updated Website pending

    • Has an updated website so that individual boards (including the Board of Architects) can communicate with all licensees on a profession-related topics, including the proposed changes to our rules and other pertinent NCARB newsworthy items.

Region 2

Highlights/Year Summary

  • Region 2 was an active participant in the Spring Regional Summit in Long Beach, CA, raising awareness of the professional and social responsibilities in addressing natural disasters. John Mateyko (DE) was a program speaker, in a call for architects and NCARB to become major players in environmental design.
  • Last year, a resolution was passed to require anyone running for NCARB office to hold an NCARB Certificate by 2017. Region 2 has asked that NCARB Certificates be offered at a reduced fee for all Member Board Members who have served for one year. This proposal is being discussed at the fall NCARB Board of Directors Meeting.
  • The region has initiated an outreach program, or educators symposium, initiated by Regional Chair Albert Zaccone, AIA, with unanimous support from the members of Region 2. The gathering will include representatives from NAAB-accredited programs, jurisdictions, Region 2, and NCARB representatives. The program is intended to be a forum that would rotate to different jurisdictions of the region, holding the event in the NY/NJ area, DC/MD, DE/PA, and VA/WV. The symposium will facilitate networking and the exchange of ideas to provide a better understanding of NCARB and its services, jurisdictional requirements for licensure, and the education of architecture students. The view of a practicing architect is also desired.
  • The goal is to enhance an understanding of roles, governing rules, changes in architectural education, and NCARB requirements for the IDP and ARE.
  • New York Member Board Member John Sorrenti, FAIA, has agreed to be the chair for the first year. The first meeting will be in New York or New Jersey in April 2016. Possible topics to discuss during these meetings include: finding an appropriate name for architect interns, the value of the NCARB Certificate, and continuing education. Suggestions of future topics are welcomed and encouraged.
    • No Region bylaw activities were necessary in 2015, with credit given particularly to Director Susan McClymonds, acknowledging her efforts in past years.
    • Prior to each meeting, the region poses a question or two for discussion within the jurisdiction to promote the sharing of opinions at its meetings. The next topics for discussion are the impact SCOTUS has had (if any) on the function of its boards and if there have been any efforts in working with code officials to minimize illegal practice.

    Disciplinary Actions

    • Receives complaints of unlicensed activity and is working with the Office of Compliance within the Department of Consumer and Regulatory Affairs to follow-up on investigation of illegal practice.
  • Maryland

    Board Composition

    • The board consists of seven (7) members appointed by the governor:

    • At least three (3) shall be graduates of schools of architecture accredited by NAAB
    • Each shall have practiced in the state for at least 10 years

    Legislative Activity

    • In 2011, through the governor’s budget, design build was permitted for horizontal projects of a certain amount and for certain state agencies and authorities. This design build authorization expired December 31, 2014. The recently passed 2015 New York state budget extended this authorization for another two years; it will now expire in April 2017.
    • Bill A3446/S1137 has been reintroduced, giving certified interior designers the capability to sign and seal construction documents for submission to building officials. The New York Board has stated its concerns on this issue.
  • Pennsylvania

    Board Composition

    • The board consists of nine (9) members:

    Legislative Activity

    • The board is meeting in July to work specifically on revising rules for registration to submit to the legislative session in January 2017, which will include the military
      licensing issue.

Region 3

Highlights/Year Summary:

  • Plans are underway for the 2016 Regional Summit in Savannah, GA, with previews by Georgia Member Board Member Anne Smith, FAIA; Mississippi Member Board Executive Jenny Wilkinson, and NCARB’s Kathy Hillegas. Savannah was chosen because of budget, ease of travel, proximity to activities, hotel suitability, and the area’s rich architectural community.
  • The biennial Educators and Practitioners Conference will be held at Tulane University on September 13, 2016 with Michael Rodriguez serving as chairman.
  • The conference will be held jointly with the Louisiana Licensing Advisors Forum (formerly the LA IDP Forum), which will provide participants with a unique opportunity to learn from Louisiana’s example, as well as wonderful dialogue with students and educators.
  • The region has increased its support of this event in recognition of the vital role of education in architectural practice and recent and upcoming changes such as the streamlined IDP and integrated path to licensure.
  • As members of the Leadership Committee, Jenny Wilkinson and Alfred Vidaurri carried the region’s wishes forward in planning the 2015 Regional Summit in Long Beach, which was deemed a success. The committee also reviewed the draft resolutions and provided feedback to NCARB.
  • During the Annual Meeting, the Region honored:
  • Cindy McKim, who retired from the Alabama Board of ArchitectsJuanita Chastain, who retired from the Florida Board earlier in the year
  • Blake Dunn, as he completed his term as past president on the NCARB Board of Directors
  • The executive committee of Region 3 met by conference call throughout the year to plan the Regional Summit, Regional Meeting during the Annual Business Meeting, and the Educators Conference.

    Board Update

    • The board welcomed Elizabeth Bern as executive director following Cindy McKim’s retirement.

    Rules and Regulations

    • The board has concerns regarding interior architecture programs and recommended this as a discussion topic during the 2016 Educators Conference.
    • The legislative sunset committee introduced a bill that would change the registration renewal date from September 30 to December 31 to coincide with the continuing education (CE) reporting period.
    • Representatives of the board recently met with leadership from a well-respected interior design school regarding use of the term “interior architecture” on their website and in promotional materials. The board urged the university to change their department’s descriptive nomenclature and add clarification to interior design degree descriptions.
    • The board continued to receive inquiries and complaints related to construction administration services on residences and buildings that do not require design services of an architect, but were, in fact, designed by a registered architect. A committee will work on a potential regulation change to address this issue.
  • Arkansas

    Board Update

    • The board welcomes Thomas Campbell as new executive director. Juanita Chastain retired after many years of service.

    • The board’s legislative initiative to add requirements for construction contract administration services suffered a setback.
    • The board is looking to make several possible rule changes in the coming year focused on updating rules to better reflect current practice methods and needs.

    Continuing Education

    • During the most recent renewal cycle, several issues related to changes made in continuing education requirements were encountered, including rule requirements falling out of sync with the model CE provisions. The board will work to bring the requirements back into alignment.
  • Georgia

    Board Composition

    • The State Board of Architects and Interior Designers consists of nine (9) members
    • Six (6) architects
    • Two (2) interior designers
    • One (1) public member
    • The board is hoping to receive long overdue appointments.

    • Georgia is reviewing rules with the hope to have a closer alignment to NCARB Model Regulations, with particular focus on the 12-month continuing education model.
  • Louisiana

    Board Composition

    • The State Board of Architecture Examiners consists of seven (7) members:
    • Five (5) licensed architects
    • One (1) architect who for seven years prior to appointment has been employed full time in architectural education
    • One (1) public member.
    • Knox Tumlin, AIA, NCARB, CSI, was appointed to the board in the position formerly held by Creed Brierre, FAIA.

    Rules and Regulations

    • The board is researching ways to offer financial support to universities, and has engaged in conversations with a fire marshal who is attempting to revise requirements in order to allow agriculture engineers and possibly interior designers to submit building plans for permitting purposes.
  • Mississippi

    Board Composition

    • The State Board of Architecture consists of five (5) members:
    • Five (5) architects who have been licensed for at least 7 years

    Board Update

    • NCARB’s Michael Armstrong, Kathy Hillegas, and Harry Falconer visited Mississippi for a board meeting. Falconer offered IDP presentations in Jackson and Starkville. The personal visits and information exchanged were invaluable and very much appreciated.

    Legislation

    • Legislation was introduced to revise the requirement for public purchase of professional services. Architectural services were exempted from bidding requirements, thus qualification-based selection (QBS) selection will continue for the public purchase of architectural services.
    • Legislation was introduced, but died, to impose a $400 per year privilege tax on professionals, including architects.
    • The board successfully sought to revise language regarding the appeal of board orders to bring the process in line with other boards and commissions.

    Rules and Regulations

    • The board continued to meet with members of the engineers board through the joint committee on building design and construction. This resulted in a joint letter to building officials and licensees stating emphatically that plans for permit/construction must show code compliance and must be complete (with reference to IBC2012 language). This was a result of several complaints the joint committee reviewed in which incomplete plans or non-code compliant plans were successfully used to obtain a building permit for construction.
  • North Carolina

    Board Composition

    • The board consists of seven (7) members appointed by the governor.
    • Five (5) of the members of the board shall be licensed architects
    • Two (2) public members
    • The board welcomed its newest member, Robert W. Bishop.

    Board Update

    • The board welcomed Laura Cordero-Agrait in the position formerly held by Pedro L. Alfaro, and we thank Pedro for all his years of dedication.

    Legislation

    • The board has not been able to convince the engineers Board and Professional Association to support efforts to establish a New Practice Act for Architecture and Landscape Architecture, separate from the practice of engineering and land surveying. Therefore, the board has decided to present its legislative project during the current session without the preferred consensus with the engineers.

    Continuing Education

    • Puerto Rico’s new continuing education regulation became effective and requires all architects and landscape architects to certify online compliance with 12 HSW CEHs for the previous calendar year, on or before January 31 each year.

    Disciplinary Action

    • The board continued to receive complaints regarding the illegal practice of interns who are offering architecture services independently and contracting directly with the public, in violation of the Practice Act. The current Practice Act requires the board certifies interns as “architects in training.” This seems to confuse the public, because clients mistake this certification to mean that the board has authorized the individual to practice independently.
  • South Carolina

    Board Composition

    • The Board of Architectural Examiners consists of six (6) members
    • One (1) professor of architecture from a state university

    Board Updates

    • The board continues to provide grants to accredited architectural, engineering, landscape architectural, and interior design programs of Tennessee colleges and universities. Grant funds may be used for computers to be utilized by students, laboratory or instructional equipment, library resources, to pay IDP fees, or examination fees for students. This year the board provided $300,000 in grant funds.
    • Former board member Bill Beaty, who served as both chair and regional director of the Southern Conference of NCARB, passed away on May 22, 2014.  He served on the Tennessee Board for 16 years, ending in 1999, and will be remembered fondly.

    Legislation

    • A bill was introduced to amend the statute to give the board specific authority to deny certificates of registration to persons with felony convictions, as well as delete the outdated, burdensome requirement to “immediately notify” the secretary of state and county, town, and city clerks of revocations and suspensions, or of the reissuance of a revoked certificate of registration.
    • The board already has authority to deny registration to persons with felony convictions through its misconduct rule, and the “good character and repute” clause in the law, legal counsel recommended that a specific reference to felony convictions be added to the law as well.
    • Another bill would increase the threshold for public works projects that require a registered architect, engineer, or landscape architect from $25,000 to $100,000.

    Rules and Regulations

    • Rule changes approved in 2013 are scheduled to become effective, including:
    • A repeal of the residency requirement for exam applicants.
    • An amendment to the education rule stating that an architectural degree from a CACB-accredited program, or a program deemed substantially equivalent by the NAAB, is deemed to be equivalent to a degree from a NAAB-accredited program.
    • A new rule providing an alternative continuing professional development option for architects and registered interior designers, which will allow registrants to report their hours on a calendar year basis (in conformity with regulations established by NCARB).
    • Future rule changes under consideration include:
    • A rule providing for expedited issuance of licenses for veterans and their spouses, waiver of renewal requirements for those on active duty, and acceptance of military education, training or experience if substantially equivalent to state standards.
    • The QBS rule will be amended to update a statutory citation and clarify that a registrant may not submit any information as part of a proposal for a public project that would enable the governmental entity to evaluate the proposal on any basis other than the competence and qualifications of the registrant.
    • New language is also being considered regarding misrepresenting one’s qualifications to a prospective or existing client or employer, and to allow experience credit for teaching experience.
    • The board continues to struggle with implementation of a rule prohibiting registrants from competitively bidding professional services on public projects, which took effect in March 2013.

    • Legislation eliminated the professional tax paid by active status architects each year, which has the effect of lowering each renewal by $200.

    • The board recently proposed a rule change mimicking the recent changes to required IDP hours, and discussed proposed changes to the BEA and BEFA programs.

Region 4

Highlights/Year Summary:

We had a productive and successful year in Region 4. Much of our success is due to an engaged Executive Committee and participation by our Member Board Members. Specific highlights include:

  • In March, Region 6 hosted the Regional Summit in Long Beach, CA, which culminated with bylaw revision discussions, region elections, and NCARB officer candidate campaigns. The 2015 Educators and Board Members Symposium was approved unanimously by the region at the Summit in Long Beach.
  • Kentucky Board Member David M. Biagi, NCARB, has graciously agreed to host the event at the University of Kentucky School of Architecture in Lexington, KY, on October 8- 9, 2015. Ken VanTine is chairing the Symposium, assisted by Stephen, Glenda, David, and NCARB Director of Experience + Education Harry Falconer, AIA, NCARB.
  • The topic for this year's Symposium is the new integrated path to licensure, including a discussion with the three Region 4 schools participating, and how students can be “license ready” upon graduation.
  • The Symposium is open to all Member Board Members and Executives within Region 4, as well as the region’s 23 architecture schools.
  • Region 4 will fund registration and lodging for one person from each school and one MBM from each state.
  • Iowa Architect, Terry Allers, AIA, NCARB, was elected secretary of the NCARB Board of Directors.

  • Illinois

    Board Composition

    • Illinois has four boards that represent the design professions: the Structural Engineering Board, State Board of Professional Engineers, Land Surveyors Licensing Board, and Illinois Architecture Licensing Board.
    • The Architecture Licensing Board consists of six (6) members.
    • Five (5) members shall be licensed architects, one of whom shall be a tenured member of the architectural faculty of an Illinois public university accredited by the National Architectural Accrediting Board.
    • One (1) public member
    • Senior Board Member Richard Cook’s term has expired, but he will serve on our board until a replacement has been appointed by the governor’s office.

    Current Number of Licensed Architects

    Board Meetings

    • Designated members of each of the four boards meet on a regular basis as the Complaint Review Committee to review all complaints, cross reference design jurisdictions, and then recommend closure, further investigation, or prosecution.

    Board Updates

    • The board has strengthened its relationship with AIA Illinois, AIA Chicago, the Association of Licensed Architects, NCARB (via conference participation and service on NCARB committees), and with NAAB (through visiting team participation).

    Disciplinary Actions

    • Normally the state receives approximately 80 complaints against architects, as well as a greater number of complaints against business entities that practice architecture, but have failed to obtain professional design firm registration.

    Rules and Regulations

    • The architecture board is actively participating in many endeavors, including but not limited to the following:
    • Alerting candidates of the January 1, 2016 deadline, after which time, all candidates seeking an Illinois architecture license will need to have a professional or master’s degree in architecture from a NAAB-accredited program to fulfill the education requirement for licensure.
    • The governor’s office is presently denying all requests for non-essential expenses including reimbursement and meeting fees for out-of-state travel.
    • The board is reviewing NCARB’s proposal for IDP streamline implementation.
    • Reviewing proposed changes to reduce the total amount of time it takes a candidate to complete the requirements for education, experience, and examination. The shortened time period should result in a lower cost to the candidate to complete the licensure process, or to obtain an endorsement to practice in Illinois for a candidate licensed in another jurisdiction.
  • Indiana

    Board Composition

    • The board consists of eight (8) members appointed by the governor.
    • Five (5) registered architects
    • Two (2) landscape architects,
    • One (1) shall be a public member.

    Current Number of Licensed Architects

    • Total number of licensed architects per NCARB’s 2014 survey: 3,291
    • In-state: 1,017
    • Out-of-state: 2,274
    • During the January 2014 to March 2015 renewal cycle, Indiana added 82 in-state architects and 157 out-of-state architects.

    Disciplinary Actions

    • Architects practicing without an active license peaked in 2012 and has tapered off, though the occasional incident is reported and reviewed by the Department of Homeland Security.
    • There have also been a high number of audited licensees who cannot show they have completed the pre-requisite number of continuing education units. Personal appearances and fines have been issued.
  • Iowa

    Board Composition

    • The board consists of seven (7) members

    • Iowa Governor Branstad has reappointed two architect members to the board, whose new terms began May 1, 2015.

    • The board shall consist of eight (8) members, seven (7) of whom shall be appointed by the Governor. The eighth member of the board shall be the chief executive officer of any NAAB accredited architectural curriculum established in the Commonwealth of Kentucky, who shall be an ex officio member with voting rights.

    Legislation

    • Numerous bills were introduced during Kentucky’s legislative 30-day session that could impact portions of the construction industry, though none directly relate to the architecture profession. Further changes and updates to Kentucky Administrative Regulations and Statutes specific to architects and certified interior designers are being compiled for consideration by the General Assembly.
    • Of much discussion by Kentucky’s numerous boards and commissions is the Supreme Court’s decision concerning North Carolina’s Dental Board.

    Board Activities

    • February and early March’s bad weather resulted in the cancellation of several board committee meetings. Representatives of the board continue to work with collateral organizations on legislative matters, including city and county government organizations, home builders, construction related professionals, and code enforcement officials.
    • As is occurring at all government levels, budgetary issues continue to be a problem as the economy has directly impacted the profession and construction industry. The Kentucky Board of Architects receives no general fund tax dollars, but generates all operating funds from generated fees.
  • Michigan

    Board Composition

    • The board consists of nine (9) members appointed by governor

    • One (1) professional engineer

    • In 2014, the board appointed Joseph Welmers as the new public member.

    • A meeting of the joint board of architects, professional engineers, and professional surveyors occurred in May 6, 2015. The board also created a process to allow for electronic application submission for new applicants (36 applicants thus far).

    • 2013 PA 178, effective February 25, 2014 – Explicitly permits the use of electronic seals.
    • SB 0149 – Would require an affidavit of merit in an action alleging malpractice or negligence against an architect from a qualified architect indicating that the defendant breached the applicable standard of care.
  • Minnesota

    • The board consists of 21 members with 10 years of licensed experience appointed by the governor:

    Board Updates

    • NCARB CEO Michael Armstrong, Director of Council Relations Kathy Hillegas, and Director of Examination Jared Zurn, AIA, NCARB, visited the Minnesota Board in December 2014. The board appreciated the opportunity for our multi-disciplinary board to meet and hear from NCARB leadership.
    • The University of Minnesota Twin Cities and Dunwoody College of Technology have started the accreditation process through NAAB. Dunwoody will offer a five-year bachelor of architecture degree, with an anticipated initial accreditation scheduled for January 2019.
    • Executive Director of the Minnesota AIA Beverly Hauschild-Baron will be retiring in April 2015 after 38 years.

    Activities

    • Intern title discussion has been ongoing. The “architect” title is protected by statute with “architectural intern” being permitted.
    • The Minnesota Board of AELSLAGID is midway through its planning process to update its long-range strategic plan.
    • Cross-disciplinary discussion continues on certification of BIM and other integrated design models.
    • The Minnesota Board of AELSLAGID biennial renewal period concluded June 2014.  This was an online renewal process, with 92 percent renewal online. Paper copies were permitted when needed.
  • Missouri

    Board Composition

    • The board consists of 15 members who have been licensed for at least 10 years:

    a chairperson, who may be either an architect, a professional engineer, a professional land surveyor, or a landscape architect

    Board Updates

    • The Missouri Board for Architects, Professional Engineers, Professional Land Surveyors, and Professional Landscape Architects (APEPLSPLA) had four meetings this past year, each in a different city: Jefferson City, St. Louis, Kansas City, and Springfield.
    • Michael Armstrong and Kathy Hillegas attended our January board meeting and made a presentation on NCARB’s behalf.

    Disciplinary Casework

    • The disciplinary caseload involving architectural practice remains low.
    • The board continues to see a number of architects who failed to inform the board of disciplinary actions they have received in other states, as well as a number of firms that fail to obtain a Certificate of Authority to provide architectural services in Missouri.
    • The biennial renewal fee for an architect’s license remains at $35 and $100 for a Corporate Certificate of Authority.
    • On August 28, 2014, major revisions to the statutes that regulate the practice of architecture in Missouri became effective. Opposition to the inclusion of construction administration and observations into the definition of architecture led to the board keeping the same definition, but all other changes, including a definition of incidental practice passed.
    • The board has been working to update the board’s rules and regulations to align with the changes.
  • Ohio

    Board Composition

    • The board consists of five (5) architects appointed by the governor with the advice and consent of the Senate.

    Current Number of Registered Architects

    • Total number of licensed architects per NCARB’s 2014 survey: 6,314
    • In-state: 3,234
    • Out-of-state: 3,080
    • As of March 2015, Ohio has:
    • 6,492 active architects,
    • 641 ARE candidates, and
    • 1,444 firms.

    Board Updates

    • Ohio members serving on NCARB’s committees include: Region 4 Chair and Regional Leadership Committee member Stephen Sharp, AIA, NCARB; Member Board Executive and Licensure Task Force member Amy Kobe, CAE, Hon. AIA; and ARE Item Development Subcommittee member John Rademacher, AIA.
    • The board continues its outreach program to Ohio’s architecture schools, visiting each school at least once annually. Bowling Green State University is a candidate for NAAB accreditation, which is expected in 2017.

    Legislation/Rules

    • The board is seeking to remove language from the continuing education statute that restricts the ability of the board to require only structured coursework, which conflicts with NCARB Model Law.
    • This conflict was discovered during a review of the Landscape Architects rules. The landscape architects board statute is identical to the architects’, so both statutes need to be changed. The sponsor hopes to correct this via the budget bill. More of the board’s rules are up for five year review (not the same as sunset) this year. No significant changes are anticipated.
  • Wisconsin

    Rules and Regulations

    • The Joint Board of Architects, Engineers, Professional Land Surveyors, Landscape Architects, and Designers have a number of administrative rule projects in process, including a rule detailing the process for electronic seals and signatures.
    • Each section is working on updating their rules according to the changes made in 2013 Wisconsin Act 114, which allows an applicant to take their exams at any time while maintaining all the current registration education and exam requirements.
    • The board established a Retired License Task Force that is considering this issue, which requires a statutory change. The board has a sponsor for the proposed bill and will continue to work through the legislative process.
    • There is also discussion on changing the license renewal process from the current two-year cycle to a four-year cycle. We will keep you posted as this discussion progresses.

    Board Updates

    • As a result of the state’s solid economy, the board has continued its response to general inquiries about licensing, as well as issuing licenses. Nearing the close of the biennium, inquiries and licenses applications have stabilized.
    • For the second renewal cycle in a row, North Dakota has lowered both the renewal fee and the original application fee.
    • As can be expected with an increase in the number of license holders, the number of complaints has also risen.
  • Oklahoma

    Board Updates

    • Obtained approval from the legislature and governor on July 1, 2014 to allow the board to fund and manage a scholarship program for Oklahoma students entering accredited educational programs.
    • The intent is to encourage Oklahoma licensing while retaining the state’s investment in these graduates. This, in turn, benefits the public by helping to ensure enough professionals are licensed to replace the retirees with as little student loan debt as possible.
    • The board’s new scholarship committee is in the process of confirming and securing details to ensure that the program is established properly and can provide long-term benefits to the people of Oklahoma.
    • The board office moved to a new permanent home in the Oklahoma Engineering & Design Professional Center where two board member architects worked on the building remodel and design.

    Rules and Regulations

    • Changes to the board’s rules effective September 2014 incorporated board policy on equivalent education for architects, landscape architects and registered interior designers, as well as some minor clean-up items.
    • Successful sunset review during the 2014 session. Board was re-created for five years.
    • Currently in the middle of the rulemaking process to add continuing education for registered interior designers.
  • South Dakota

    Board Updates

    The South Dakota Board of Technical Professions continues to work on updating and providing information to our members. Recent projects include:

    • Updating handbook for South Dakota building officials and design professionals, which provides quick references to requirements and information on communities without building officials.
    • Clarifying an issue with cross practice in construction administration to keep professionals from overstepping on inspections and observations during construction periods.
    • Updating electronic plans distribution requirements and guidelines along with updating the professional Seals Guideline document.
    • Rewriting petroleum release exam and review experience required for assessors and remediators.
    • Working through electronic and digital signatures definitions and requirements. This item will require statute and rule changes as the board has clarified its position and will be issuing changes to the rules and statutes on the use of this methodology.

    Board Updates

    The Wyoming Board is moving forward with numerous directives that came from the creation of their strategic plan. These include:

    • A collaboration effort with the Board of Professional Engineers and Professional Land Surveyors and the Board of Professional Geologists. This effort began with a meeting to create a single brochure for all of these professions to be handed out first at the Wyoming Association of Municipalities. Continued collaborative efforts will be made for brochures for different target markets—such as students—and sharing more information across our state about these professions and the importance of licensing.

Region 6

Highlights/Year Summary:

  • Region 6 hosted the Regional Summit at Long Beach, CA, in March 2015.
  • Vice Chair Jay Cone was appointed chair of the education committee to explore and select educational opportunities as well as topics of interest for the regional summit attendees.
  • Secretary Ed Marley was appointed to create a WCARB home video, which features architecture of all of the jurisdictions in the region. Sections of the video can be used by jurisdictions to present to their legislators to demonstrate the value that architecture regulation has in their state.
  • In December 2014, the executive committee met in Las Vegas, NV, to plan the Regional Summit event, review the video for the summit, and discuss educational opportunities and guest speakers.
  • A field team consisting of the region executive, chair, and one member from the education committee made a trip to Long Beach to scout the various venues and review the education opportunities presented by the committee. Final preparations were made in conjunction with the Regional Leadership Committee and NCARB support.
  • At the Regional Summit, Bob Calvani was elected as the regional director, Ed Marley was elected secretary/treasurer, Jay Cone was elected to the executive committee, Jon Baker was elected vice chair, and Jim Oschwald was re-elected as chair.
  • The jurisdictions reviewed and discussed resolutions put before the membership, and candidates for NCARB officers.
  • Reports from each of the states were heard, and the region received a lecture from Long Beach town planners Angela Reynolds and Ira Brown, receiving a continuing education hour (CEH) credit for participation. This year was the first year that Region 6 provided CEH certificates to the membership for attending the educational component of the Region 6 meeting.
  • Jim Oschwald and Region Executive Gina Spaulding followed up with the Regional Leadership Committee by conducting a survey of all of the Regional Summit attendees to understand better how the summit might address the needs of the Member Boards and their constituents.

    Brief Overview of Current Issues

    • The board is trying to refocus upon its core mission: the licensure and regulation of architects, engineers, landscape architects, geologists, and surveyors, and away from the certification of those employed in unrelated occupations.
    • There are three bills currently pending in the Arizona Legislature intended toward that end.
    • Current Legislation Related to Architecture
    • The architectural and engineering associations are sponsoring a “prompt payment of prime professionals” bill in the Arizona Legislature.

    Miscellaneous

    • The Arizona Board remains curious about the WCARB dues question; supportive of NCARB’s proposed streamlining of IDP and of the proposed changes to BEA and BEFA programs.
  • California

    Board Composition

    • The board consists of 10 members
    • Five (5) architects

    • The governor shall appoint three of the public members and the five licensed members, and the Senate Rules Committee and the Speaker of the Assembly shall each appoint a public member
    • Other licensed professionals: (5 member Landscape Architects Technical Committee, which is a subsidiary of the board)

    Current Issues

    • Sunset Review
    • The board is currently going through the Sunset Review process. The board submitted a comprehensive report to the Legislature in October 2014 and the hearing on March 18, 2015.
    • Accelerated Path to Architectural Licensing
    • Since NCARB first convened its Licensure Task Force, the board has been considering alternative paths to architectural licensure. In February 2014, the board held a summit where California NAAB-accredited programs provided presentations and feedback on approaches that would integrate examination and internship with education.
    • In September 2014, the board adopted a support position statement, which was forwarded to NCARB. A second, follow-up summit with California NAAB-accredited programs was held in March 2015 in Long Beach.
    • California Supplemental Examination (CSE) Occupational Analysis (OA)/ARE Review/Linkage Study
    • The board conducts an OA every five to seven years to identify content that is relevant to current architectural practice and satisfy California law requiring a review of any national examination administered by a state agency. After conclusion of the review, a linkage analysis is conducted to ascertain the appropriate content for the associated state licensure examination and a new test plan from which examination items can be developed is created.
    • The board, through its test developer (the Office of Professional Examination Services [OPES]), began the CSE OA process in early 2014. It was concluded in December 2014 with a report presented by OPES at the board’s meeting. OPES also worked with NCARB to conduct the methodological review of the ARE, which was completed in May 2015. Next will be a linkage analysis expected in July 2015 and a new CSE test plan and item writing for the next versions of the CSE in 2016.

    Current Legislation Related to Architecture

    • Assembly Bill (AB) 178 (Business and Professions Committee) [Sunset Review] extends the sunset date for the board and the LATC until January 1, 2020.
    • Senate Bill 704 (Bates) [Conflict of Interest] establishes an additional new provision of the Government Code regarding the prohibition of public officials from being financially interested in any contract made by them in their official capacity as a member of a governmental body.
    • AIACC-sponsored legislation (bill number pending) amends the Architects Practice Act provisions governing corporations to be consistent with the Corporations Code.
  • Colorado

    • The board consists of 13 members appointed by the governor

    • Possible redrafting of rules to make CE requirements more comprehensive—specifically outlining timing issue.

    Current Legislation

    The board is watching, but not currently participating in the following:

    • Reciprocity To Practice Occupation Or Profession
    • Was looking to expand Colorado’s military spouse bill to all persons during their first year of residence. Architects (along with engineers and land surveyors) were eventually exempted from this bill and are currently exempt from the military spouse bill. This bill was postponed indefinitely.
    • SB15-091
    • The bill reduces the maximum statutory limitation period for an action against an architect, contractor, builder or builder vendor, engineer, or inspector performing or furnishing the design, planning, supervision, inspection, construction, or observation of construction of any improvement to real property from eight years to four years. This bill is pending scheduling of a committee hearing.
    • SB15-177
    • The bill states that when the governing documents of a common interest community require mediation or arbitration of a construction defect claim and the requirement is later amended or removed, mediation or arbitration is still required for a construction defect claim. These provisions are in section 2 of the bill. Section 2 also specifies that the mediation or arbitration must take place in the judicial district in which the community is located and that the arbitrator must:
    • Be a neutral third party;
    • Make certain disclosures before being selected; and
    • Be selected as specified in the common interest community's governing documents or, if not so specified, in accordance with the uniform
      arbitration act.
    • Section 1 adds definitions of key terms.
    • Section 3 requires that before a construction defect claim is filed on behalf of the association:
    • The parties must submit the matter to mediation before a neutral
      third party; and
    • The board must give advance notice to all unit owners, together with a disclosure of the projected costs, duration, together with a disclosure of the projected costs, duration, and financial impact of the construction defect claim, and must obtain the written consent of the owners of units to which at least a majority of the votes in the association are allocated.
    • Section 4 adds to the disclosures required prior to the purchase and sale of property in a common interest community a notice that the community's governing documents may require binding arbitration of certain disputes.
    • This bill is pending scheduling of a committee hearing.
  • Guam

    Disciplinary Actions

    • The bureau investigated five complaints for the board during fiscal year 2014.

  • Nevada

    Board Composition

    • The board consists of nine members appointed by the governor

    • The board welcomed new public member Nathaniel Waugh

    Board Updates

    • Priority objectives for 2015-16 include educational outreach, public outreach, organizational efficiency, including major technology upgrades and organizational development.
    • Last year, the board invested in a new database that provides greater access to public information, better functionality, and online renewal capability.
    • In the first year of offering the ability to renew online, over 75 percent of Nevada registrants chose this option.
    • Recently, the board reviewed and updated the residential design examination to the 2012 International Residential and 2012 International Building Codes, a major undertaking.

    Current Legislation Related to Architecture

    • The 78th session of the Nevada Legislature is currently tracking over 250 bills out of the 1,251 that have been introduced. The governor signed the first bill within the first week of session, concerning construction defect reform.
  • New Mexico

    Board Composition

    • The board consists of seven (7) members appointed by the governor
    • 6 architects with 10 years’ experience
    • One shall be in architectural education in an accredited college of Arch.
    • 1 public member
    • The board welcomed attorney Mark Glenn of Albuquerque as its newly appointed public member.

    Board Updates

    The board is preparing to launch a new website, which will feature online renewal and updated access on the status of registrants.

    • During the past year, the board met with architects, students, and the public regarding the issue of reciprocity for broadly experienced architects who did not have NCARB certification.
    • The board also reviewed and discussed recent national debate regarding NCARB’s process for certification of broadly experienced architects. The board’s view is that a NAAB-accredited degree should retain its value as part of the three-part foundation for licensure.

    Legislation

    • The board is pursuing amendments to the New Mexico Architectural Act in the current 60-day session of the New Mexico Legislature.
    • Senate Bill 549 addresses these important issues:
    • Increase maximum financial penalty amount in disciplinary section;
    • Clarify that the board has authority to administratively discipline those who offer architectural services without a license practice;
    • Provide broader language regarding the reciprocity process for broadly experienced architects in light of local, regional and national discussions.
    • State lawmakers proposed requiring qualification-based selection of public entities—home rule cities in New Mexico—which are currently exempt from this requirement. The bill has been proposed in the current 60-day legislative session.
  • Oregon

    Board Updates

    • The board welcomed Maria Brown as the new administrator.
    • The board proposed a rule change that will keep the current IDP requirements in place, as outlined in the July 2015 NCARB Intern Development Program.
    • The board requires candidates applying for registration through reciprocity to meet experience requirements, or document two years of consecutive and active practice in architecture in a board-recognized jurisdiction after initial registration.
  • Utah

    Board Composition

    • The Architects Licensing Board consists of five (5) members:
    • Four (4) licensed architects
    • One (1) public member
    • Member Board Executive Stephen Duncombe and assistant Tracy Taylor are in their second year guiding the board.
    • New public board member Ryan Peterson has been appointed to fill the vacancy created by Mary Bearnson.
    • Bryan Turner was elected board chairman and Bret Bullough is the acting architect licensing advisor.

    Board Updates

    • Utah is an NCARB direct registration member for the ARE.
    • Architectural interns with a degree from a NAAB-accredited program who have enrolled in the IDP are encouraged to begin taking the ARE as soon as possible to obtain their licenses.
    • Utah requires registrants to complete 12 hours of health, safety and welfare (HSW) qualified continuing education hours, which aligns with NCARB Model Law.
    • The Board recommended funding for 20 architecture student’s initial NCARB registration.
    • Since 2005, the board has recommended funding student initial registration for graduate students at the University of Utah School of Architecture + Planning, Utah’s only NAAB-accredited program.
    • The State of Utah places a portion of each registrant’s licensure or renewal fee into an “education and enforcement fund,” which is utilized on recommendation of the board to provide funding for programs, speakers or initiatives that further education of Utah architects.
    • The board also recommended the funding of a number of opportunities this year, including notable speakers to the AIA Utah Annual Conference. Funding was also provided to the University of Utah School of Architecture + Planning to cover expenses of speakers in their Lecture Series.
    • The Utah Board is continually working to improve the clarity and accuracy of the Architect Licensing Act Rule, as well as identifying changes that may be beneficial to our profession. The board will be looking at a rule change to update the name of “IDP Coordinator” to “Architect Licensing Advisor.”
    • The University of Utah School of Architecture + Planning is looking into the NCARB’s Integrated Path Initiative.
    • The board was visited by NCARB CEO Mike Armstrong and Council Relations Director Kathy Hillegas at its October 2014 meeting.

    Current Legislation

    • There is currently one architect serving in the State of Utah House of Representatives. As of February 2015, legislation currently under consideration includes the following:
    • HB 126 – Interior Design Licensure. A bill introduced to allow interior designers who have completed the NCIDQ requirements to be licensed and stamp plans. The bill would also create a new licensing board independent of the architects licensing board. Currently, state law provides an exemption allowing work to be done without an architect’s stamp on projects under 3,000 square feet.
    • HB 235 – Occupational Licensing Amendments. A bill introduced that would require an alternative pathway to be established for time bases licensing requirements.

    Disciplinary Actions

    • Utah employs an investigator to explore complaints of possible violations. In 2014, a number of complaints were investigated, but none received administrative sanctions or criminal filings.
    • There were no disciplinary actions taken in 2014.
  • Washington

    Board Updates

    • The Board for Architects implemented a new Guidelines for building officials and design professionals website in early 2014.
    • The board continues to look at ways to bring clarity to the overlap in scope of practice among design professions and the website is regularly assessed for needed improvements.
    • The board continued its outreach efforts by meeting in different regions around the state and on university campuses like Washington State University
    • The board remains committed to providing exam candidates and licensees friendly and efficient procedures and services, communicating with licensees (via our website, listserv, and news bulletins) and listening to concerns, pursuing disciplinary cases, and supporting laws that protect the health, safety, and welfare of Washington citizens. The board’s listserv grew to 1,010 members in 2014.
